Sometimes the decisions of higher courts seem just as rational as the title of this post. Many times I have been frustrated reading the opinions of the courts when I feel that they are completely wrong. The reasoning is flawed, relevant facts are excluded, and important policies are overlooked. Of course this is merely my opinion, and I am entitled to it. I have an opinion because I am human. But wait, I guess the Justices and Judges are human too.

The simple fact of the matter is that reasonable persons are entitled to disagree, and they very often do. The next time you are reading an opinion and think to yourself “what was that judge thinking?!”, remember that if you were the judge writing the opinion others would think the same thing about you.

The law is the law and it is based on what real human beings think it should be. We may disagree, and that is a good thing. It is what keeps the law going and changing and growing with the progress of the nation. If you are in class and you disagree with a case you are studying then say something. Make your argument and state your reasoning. You may just have a great point.
